Terms of Use

Terms and conditions governing the use of Pagelark.

1. Acceptance of Terms

By downloading, installing, or using Pagelark (“the App”), provided by NetSoftTouch (“we”, “us”, or “our”), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not download, install, or use the App.

2. License and Scope of Use

We grant you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use Pagelark on Android devices that you own or control, strictly in accordance with these Terms and applicable Google Play Store Terms of Service.

3. User Content & Intellectual Property Rights

Your Content: You retain full ownership, title, and intellectual property rights in all documents (PDF, EPUB, DOCX, TXT), images, texts, and materials that you import, paste, or scan using Pagelark. Because Pagelark processes all files entirely on your local device, we do not host, store, or claim any rights to your content.

Your Responsibility: You are solely responsible for ensuring that you have the lawful right, permission, or license to import, scan, and listen to the documents and web articles you process through the App. You agree not to use the App to infringe upon any copyright, trademark, patent, trade secret, or other proprietary rights of any third party.

App Intellectual Property: All rights, title, and interest in and to the Pagelark software, design, interface, code, and documentation (excluding open-source components and your user content) are and will remain the exclusive property of NetSoftTouch.

5. Acceptable Use and Restrictions

Subject in all cases to Section 5.1 below, which prevails over this Section 5 wherever the two would conflict, you agree not to:

5.1 Open-source components: your rights to modify and reverse engineer

Pagelark includes open-source software. Each such component remains governed by its own licence, and where that licence grants you rights that are broader than these Terms, that licence governs and these Terms do not restrict those rights. The open-source components, their licences and the full licence texts are listed in the App under Settings → Open-source licences.

One of those components carries conditions that these Terms must satisfy, and this section is how they are satisfied. Pagelark uses LAME 3.100, an MP3 encoder, to produce MP3 files during audio export. LAME is free software licensed under the GNU Library General Public License, version 2 (LGPL v2). It is unmodified, and it is bundled as its own separate shared library (libmp3lame.so) rather than linked into the App, specifically so that it can be replaced.

We therefore expressly permit you to:

These two permissions are granted to satisfy Section 6 of the LGPL v2, which allows the App to be distributed under terms of our choosing only if those terms “permit modification of the work for the customer’s own use and reverse engineering for debugging such modifications”. Nothing elsewhere in these Terms limits them.

These permissions apply to modification and debugging for your own use. They are not a licence to redistribute the App or a modified version of it, to remove or alter attribution or licence notices, or to redistribute the proprietary parts of the App — the Pagelark code, design and assets described in Section 3 — and they do not affect the restrictions in Section 5 that Section 5.1 does not expressly override.

6. Third-Party Services and External Content

Pagelark integrates third-party services including Google AdMob, Google Firebase (Analytics & Crashlytics), and Google Play Billing. Your use of these services is subject to their respective terms and privacy policies. When you fetch web articles via URL, you are accessing third-party websites that are independent of NetSoftTouch.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE APP (INCLUDING DOCUMENT PARSING, OPTICAL CHARACTER RECOGNITION, OR TEXT-TO-SPEECH SYNTHESIS) WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY DOCUMENT FORMAT OR DEVICE CONFIGURATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NETSOFTTOUCH OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

9. Modifications to Terms

We reserve the right to revise or update these Terms of Use at any time. Updated terms will be posted on this page with a revised effective date. Your continued use of the App following any changes signifies your acceptance of the updated Terms.
